General Law

The general law indicators ask questions about how the Constitution and legislation enable people to assert their rights of access as outlined in Principle 10. They look at general issues of freedom to act as an individual and to gather together with others to express views and disseminate ideas.

Recommendations for changes in general law.

o An amendment to the Constitution to include the right to a clean and healthy environment, and the rights of access to information, public participation and justice in environmental decision-making.

o Encouraging generation of precedent through Public Interest Cases

o Greater clarity in the drafting of laws.

o The removal of the costs barrier in environmental justice cases.

o The removal of financial barriers to participation in administrative appeals.

o Shifting the burden of proof.

o The establishment of a legal framework for NGO's.

o Broader financial support for regional local and national NGOs.

o Reform of the structures of legislation.
